Under the new Building Safety Act 2022, Principal Accountable Persons can start registering their higher-risk buildings (HRBs - Residential buildings over 18m/or 7 storeys) from 6 April 2023. They have until October 2023, when more in occupation duties come into force and accountability (and liability) for further information requirements such as the golden thread and the safety case will commence.

The legal basis for the information required is The Building Safety (Registration of Higher-Risk Buildings and Review of Decisions) (England) Regulations 2023, which includes the content of the information to be submitted, directions to be made by the regulator and the fee for an application submission (£251) amongst others.

Also from 6 April, the key building information requirements come into force.  These state that as part of the registration process (of every single HRB), the PAP will also be required to submit the key building information within 28 days of the PAP submitting an application for registration of that higher-risk building. They will submit several documents comprising ‘Key Building Information’ – as set out in Regulations 3-8 of the draft The Higher-Risk Buildings (Key Building Information etc.) (England) Regulations 2023 -HRB (KBI) Regulations, through a portal hosted by the regulator.

As part of our support for our members, Anthony Taylor and Mark Snelling, have written a short guidance about what to expect to be captured by the two regulations. In addition, they have also provided a comprehensive answer to the question of whether FMs can be a Principal Accountable Person.  Find out under which limited circumstances this is possible by reading their guidance here.

Over the coming weeks and months, we will publish more of these notes, all of which will be published under the 'Guidance' section of our Building safety hub.
